Terms of Service

Agreement

These Terms are between you and Hergen Roque Gamayon, operating as Hergen in Tech (“we,” “us,” or “our”). You must be legally able to enter into this agreement. If you use the Services for an organization, you confirm that you can bind it to these Terms. Terms shown with a specific Service also apply and control if they conflict with these Terms.

Accounts and service

You must provide accurate information, protect your login credentials, and promptly report unauthorized access. You are responsible for activity under your account.

We give you a limited, revocable, non-transferable right to use the Services as intended. We may update them over time and will give reasonable notice if a change materially reduces the core functionality of a paid Service.

Acceptable use

You may not:

• break the law or violate another person’s rights;
• upload unlawful, harmful, fraudulent, or infringing material;
• introduce malware or interfere with the Services;
• access accounts, systems, or data without permission; or
• scrape, reverse engineer, bypass limits, or resell the Services without permission.

Content and ownership

You keep ownership of content you submit and give us permission to host, process, and use it only to operate, secure, and improve the Services or comply with law. You confirm that you have the rights needed to submit it.

We or our licensors own the Services, including their software, design, branding, and original content. These Terms do not transfer that ownership to you.

Payments

Prices, taxes, billing periods, and automatic renewal will be disclosed before purchase. Renewing subscriptions continue until canceled and cancellation takes effect at the end of the current billing period.

Except where required by law or stated in a Service-specific policy, payments are non-refundable. Price changes apply no earlier than the next renewal after reasonable notice. Mandatory consumer rights remain unaffected.

Third parties and privacy

The Services may rely on third-party products such as payment and hosting providers. Their own terms apply, and we are not responsible for services we do not control. Our Privacy Policy explains how we handle personal information.

Termination

You may stop using the Services at any time. We may suspend or end access if you materially violate these Terms, fail to pay, create a security or legal risk, or if we discontinue a Service. When practical, we will provide notice and an opportunity to resolve the issue.

Disclaimers and liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted, secure, or error-free operation. You are responsible for deciding whether the Services meet your needs and for keeping backups.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses. Our total liability will not exceed the greater of the amount you paid for the affected Service during the prior 12 months or PHP 5,000. This does not limit rights or liabilities that cannot legally be excluded.

General terms

Philippine law governs these Terms. Before filing a formal claim, each party agrees to try to resolve the dispute in good faith for 30 days. Unresolved disputes may be brought before a court with jurisdiction under Philippine law, without limiting mandatory consumer remedies.

We may revise these Terms and will give reasonable notice of material changes. If any provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
